Start with whose tree it is

If the tree is in the parkway strip or otherwise City-owned, it's maintained by the Modesto Forestry Division. Call them before cutting roots, grinding near the trunk or removing anything, and ask how the City handles the related concrete repair. If the tree is on your own lot, root work is your decision, but a certified arborist should advise before cutting large roots.

Who is responsible for the sidewalk?

California's Streets and Highways Code section 5610 makes owners of property along a public street generally responsible for keeping the sidewalk in safe condition. Modesto has its own sidewalk repair provisions in Municipal Code Title 7, so check with the City how they apply to your address, especially when a City tree caused the damage.

The permit

Sidewalk, curb, gutter and driveway approach work is in the City right-of-way and needs an encroachment permit from Land Development Engineering, applied for on the City's Engineering Standard Application. Contractors need workers' compensation and liability insurance on file with the City. Questions go to LDEpermits@modestogov.com or (209) 342-4712.

How the repair is done and what it costs

The lifted panels are removed, roots are pruned where it's safe for the tree, a root barrier goes in, and new concrete is poured, sometimes thicker near the tree. Replacing a few panels typically runs $10–$18 per square foot because of setup, haul-off and the permit. Grinding a raised edge can remove a trip hazard temporarily but doesn't stop the roots.

Common questions

Who do I call about a City tree lifting my sidewalk?

The Modesto Forestry Division at (209) 342-2253.

Do I need a permit to replace sidewalk panels in Modesto?

Yes, an encroachment permit from Land Development Engineering.

Will a root barrier hurt the tree?

Installed correctly and with an arborist's input on large roots, barriers redirect roots downward without killing the tree.
